Eternum Health LLC, a New Jersey limited liability company doing business as Blue Haven RX, together with its affiliates (“Company,” “we,” “us,” or “our”), makes information available regarding remote weight loss treatment programs and facilitates access to telehealth and medical services provided by the Professional Entities identified in our Terms and Conditions. This Privacy Policy describes how we collect, use, disclose, and otherwise process information that may identify you (“Personal Information”) collected through your interactions with www.bluehavenrx.com, go.bluehavenrx.com, my.bluehavenrx.com, any other Blue Haven RX subdomain, and any related web or mobile application that requires you to create an account (collectively, the “Site”), as well as the services accessible through the Site (the “Services”).
By accessing or using the Services, you signify that you have read, understood, and agree to our collection, storage, use, and disclosure of your Personal Information as described in this Privacy Policy. We reserve the right, at our discretion, to change, modify, add, or remove portions of this Privacy Policy at any time. Material changes will be conspicuously posted on the Site or otherwise communicated to you. All changes will be effective immediately upon posting to the Site.
This Privacy Policy does not apply to users of our Services located outside the United States or to third-party websites or services that may be linked from our Services. The Site is hosted in the United States.
Minors Under the Age of 18
The Site and Services are not intended for minors under 18 years of age, and we do not knowingly collect Personal Information from minors under 18. If we learn that we have collected or received Personal Information from a child under age 13 without verification of parental consent, we will delete that information. Information We Collect About You
We may collect Personal Information directly from you through the Site and Services, from third parties, and automatically through your use of the Site and Services.
Account, Demographic, and Contact Information.
To use the Services, registration is required. As part of registration, you are asked to provide certain Personal Information, including your name, date of birth, address, email, phone number, and certain transactional information. The email address you provide will be used for correspondence regarding your account, your medical information, and your prescriptions.
Site Usage and Log Information.
When you interact with the Site, we automatically collect usage information, including IP address, browser and device information, pages or features you access, referring and exit pages, and date and time stamps.
Location Information.
Your location information may be derived from your IP address, your device, or other location-based components of the Services.
Financial and Payment Information.
If a credit card or debit card is used to pay for the Services, we may collect information necessary to process the transaction, such as the card type, number, and expiration date. Payments are processed by a third-party payment processor.
Photographs and Identification.
Certain portions of the Services require you to submit photographs (for example, of your government-issued identification or for clinical evaluation). We collect these images in order to provide the Services and to verify your identity.
Personal Information Obtained from Third Parties.
We may receive Personal Information about you from third parties, including the Professional Entities, your treating healthcare provider, the Pharmacies that fulfill prescriptions, advertising and analytics providers, and other service providers, in each case where permitted by applicable law.
Patient Information.
If you use the Services to seek treatment, you will be required to complete a medical profile in which you provide health-related information. We pass that information through to your assigned healthcare provider, licensed to practice in your jurisdiction, along with your registration information and identification documents. The healthcare providers who provide services through the Services are the Professional Entities identified in our Terms and Conditions (each, a “Provider”). The Company is not responsible for any Provider’s use of your Personal Information. We encourage you to review the applicable Provider’s Notice of Privacy Practices.
Prescription Information and Pharmacies.
If your Provider issues a prescription, the Services facilitate the placement and delivery of that prescription through one or more pharmacy partners (each, a “Pharmacy”). The Company is not responsible for any Pharmacy’s use of your Personal Information.
HIPAA Does Not Apply to the Company.
Information provided through the Services to the Company, whether or not also disclosed to a Provider or a Pharmacy, is not considered “protected health information” under the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations and amendments (collectively, “HIPAA”), and is not subject to HIPAA in the hands of the Company. The Company is not a covered entity. Health information held by your Provider is governed by HIPAA in the hands of the Provider and is subject to the Provider’s Notice of Privacy Practices. Any medical or health information that is subject to specific protections under applicable state or federal law (including state consumer health data laws) will be used and disclosed in accordance with those laws.
Cookies and Tracking Technologies
We and our service providers use cookies, pixels, software development kits, web beacons, and similar technologies (collectively, “Tracking Technologies”) to collect information about your interactions with the Site, to operate certain features of the Site, to support analytics, and to support advertising and measurement on third-party platforms.

Most browsers also allow you to block, delete, or disable cookies, and most mobile devices allow you to disable transmission of unique identifiers and location data. If you reject cookies or block device identifiers, some features of the Services may not be available or may be limited.
We do not respond to Do Not Track (“DNT”) signals sent by browsers at this time.
How We May Use Your Information
Depending on which Services you use and how you interact with us, we may use your Personal Information to:
administer the Services and process transactions;
respond to your inquiries and provide information about the Services;
send you marketing communications, as permitted by applicable law and your consent preferences;
deliver advertisements that may be of interest to you on third-party platforms, as permitted by applicable law;
improve the Services and user experience, including through analytics, quality control, and security activities;

Healthcare Providers and Professional Entities. We share information you provide with the Professional Entities and the licensed healthcare providers who treat you.
Pharmacies. We share information necessary to fulfill prescriptions with the Pharmacy or Pharmacies that dispense your prescriptions.
Affiliates and Service Providers. We share Personal Information with our affiliates and with vendors and service providers that perform services on our behalf, including hosting, payment processing, identity verification, customer support, communications, analytics, and advertising services.
Advertising Partners. We share certain Personal Information with third-party advertising platforms for purposes of advertising and measurement, as further described in the State Supplemental Privacy Notices below.
Legal Obligation or Safety. We may disclose Personal Information when we have a good-faith belief that doing so is reasonably necessary to comply with applicable law or legal process, enforce our Terms and Conditions, detect or prevent fraud or security issues, or protect the rights, property, or safety of our users or the public.
Corporate Transactions. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets, Personal Information may be transferred as part of that transaction.
We do not sell Personal Information for monetary compensation. As described above, certain disclosures of Personal Information for cross-context behavioral advertising may be considered a “sale” or “sharing” under certain state privacy laws.
We may disclose aggregated or de-identified information without restriction, subject to applicable law. We will not attempt to re-identify any de-identified data we maintain or use.
Marketing Communications

Even if you opt out of marketing communications, we may continue to send you transactional or administrative communications as permitted by law.
How We Protect Personal Information
We use commercially reasonable physical, technical, and administrative safeguards to protect the confidentiality and security of Personal Information. No method of transmission or storage is 100% secure, and we cannot guarantee the security of Personal Information.
Accessing, Correcting, Updating, and Deleting Your Personal Information
You may access and update certain information, or deactivate your account, through the member portal at my.bluehavenrx.com. You may also request access to, correction of, updates to, or deletion of your Personal Information by contacting us at support@bluehavenrx.com. We will respond to such requests as required by applicable law. In certain circumstances, we may deny a request as permitted or required by law and will inform you of the reason. Where Personal Information has been disclosed to third parties or retained in archives or backups, we may not be able to access or cause those parties to delete or modify it.
Retention of Personal Information
We retain Personal Information for as long as necessary to fulfill the purposes for which it was collected, as described in this Privacy Policy, or as required by law. Factors we consider in determining retention periods include the length of our ongoing relationship with you, applicable legal obligations, and our legal position in light of statutes of limitations, litigation, and regulatory investigations.

California “Shine the Light” Disclosure
Under California Civil Code Section 1798.83, California residents who have an existing business relationship with us may request information about our disclosure of certain categories of Personal Information to third parties for the third parties’ direct marketing purposes, if any. To make such a request, please contact us at support@bluehavenrx.com. Not all information sharing is covered by these California privacy rights, and only information about covered sharing will be included in our response. This request may be made no more than once per calendar year.
Consumer Health Data (Washington and Nevada Residents)
This section provides additional disclosures and rights for residents of Washington and Nevada with respect to consumer health data, as defined under the Washington My Health My Data Act and the Nevada consumer health data law (collectively, “CHD Laws”).
Categories of Consumer Health Data Collected.
In connection with the Services, we may collect the following categories of consumer health data: information related to your interest in or use of weight loss and related healthcare services; information you submit through intake forms relating to your physical or mental health condition, weight, height, body measurements, current and prior medications, allergies, and pregnancy or breastfeeding status; biometric or photographic data you submit; precise or approximate location information that may be derived from your IP address or device; and any inferences derived from the foregoing.
Categories of Sources.
We collect consumer health data directly from you, automatically through your use of the Services, from your treating healthcare provider and the Professional Entities, and from the Pharmacies that fulfill prescriptions.
Categories of Third Parties with Whom We Share Consumer Health Data.
We share consumer health data, as necessary, with the Professional Entities and your treating healthcare provider, the Pharmacies that fulfill your prescriptions, our service providers, and as required by law or as part of a corporate transaction. We do not sell consumer health data, as that term is defined under CHD Laws.
Your Rights Regarding Consumer Health Data.
Subject to certain limitations, you have the right to (i) confirm whether we are collecting, sharing, or selling your consumer health data, and to access that data; (ii) withdraw consent to our collection and sharing of consumer health data; and (iii) request that we delete your consumer health data. To exercise these rights, contact us at support@bluehavenrx.com. We will respond as required by applicable law.
Authentication.
Because consumer health data is sensitive, we apply heightened authentication procedures before responding to requests under CHD Laws. We may request additional information to verify your identity beyond what we require for other types of privacy requests.
Right to Appeal.
If we deny your request, you may appeal our decision by replying to the communication denying your request or by emailing support@bluehavenrx.com within thirty (30) days. If we deny your appeal, you may submit a complaint to the Washington State Attorney General or the Nevada Attorney General, as applicable.
California Privacy Rights Notice
THIS SECTION PROVIDES ADDITIONAL PROVISIONS APPLICABLE ONLY TO RESIDENTS OF CALIFORNIA. If any information in this section conflicts with the main body of this Privacy Policy, the information in this section controls for California residents. The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, and its implementing regulations (collectively, the “CCPA”), require us to provide California residents with the additional disclosures set forth below. Capitalized terms used in this section that are not defined in this Privacy Policy have the meanings given to them under the CCPA.

We retain Personal Information, including Sensitive Personal Information, for as long as needed or permitted in light of the purposes for which it was collected and consistent with applicable law. Criteria used to determine retention periods include the length of our ongoing relationship with you; whether we are subject to a legal obligation requiring retention; and whether retention is advisable in light of our legal position (such as applicable statutes of limitations, litigation, or regulatory investigations).

In the last 12 months, the categories of Personal Information described above may have been disclosed to the categories of third parties set forth under “How We May Share Your Information.”
Sale or Sharing of Personal Information.
We do not sell Personal Information for monetary compensation. However, under California law, sharing certain data with certain third parties for online behavioral advertising may be considered a “sale” or “sharing” of Personal Information. In the past 12 months, we may have shared the following categories of Personal Information with third-party advertising platforms for purposes of cross-context behavioral advertising:
identifiers;
internet or other electronic network activity; and
inferences derived from the foregoing.
We do not have actual knowledge that we have sold or shared the Personal Information of any consumer under the age of 16. You may opt out of our “sale” or “sharing” of your Personal Information as described below.
Sensitive Personal Information.
Although we use commercially reasonable measures to limit the disclosure of health-related information to advertising platforms, certain Sensitive Personal Information may be disclosed in connection with our advertising activities. You may opt out of this disclosure as described below.
Your California Privacy Rights.
If you are a California resident, subject to certain limitations, the CCPA allows you to make the following requests at no charge:
Request to Delete: the right to request deletion of certain Personal Information we have collected.
Request to Access: the right to request access to and, subject to certain exemptions, receive a copy of the specific pieces of Personal Information we have collected.
Right to Know: the right to request information about the Personal Information we have collected, used, or disclosed about you in the last 12 months, including categories, sources, business purposes, and categories of third parties.
Right to Correction: the right to request that we correct inaccurate Personal Information.

Submitting a Request.

Please include your full name, email address, and the address associated with your use of the Services, along with an identification of the rights you would like to exercise. You may make a request on behalf of yourself or a minor in your custody, or you may authorize an agent to exercise your rights with written, signed permission.
Verification.
We may require additional information to verify your identity and the authenticity of your request. We will only use Personal Information collected during the verification process for that purpose. We may deny your request as permitted or required by law and may charge a fee to process or respond to a request that is excessive, repetitive, or manifestly unfounded. State Supplemental Privacy Notice (Other Covered States)
